Regulation (EU) 2015/2283 on novel foods

After a transition period of 2 years, Regulation (EU) 2015/2283 on novel foods has been in effect in most parts since January 1, 2018. It fully replaces the previous Regulation (EC) No. 258/97. Changes compared to the old regulation mainly concern the scope and the authorization procedure.

For novel food applications, EFSA had already developed guidelines in November 2016. Implementing regulations dealing with the administrative and scientific requirements for novel food applications and applications for traditional foods from third countries were adopted by the Commission and published on December 30, 2017. They are the Implementing Regulations (EU) 2017/2468 and (EU) 2017/2469. They enter into force on January 19, 2018.

In this context, existing authorizations and notifications were also included in a Union List. These can be found in Implementing Regulation (EU) 2017/2470. This was also published on December 30, 2017, and enters into force on January 19, 2018.

This allows authorizations to be utilized by any food business operator, eliminating the need for applications for equivalent products. However, caution is initially advised, as not all specifications of novel foods may have been adopted due to delayed notifications by member states. If such errors are discovered later, the Commission has already announced corrections.
