Based on the scientific advice of the SCCS from May 2021, a new regulation regarding the declaration of products containing formaldehyde is expected in the first quarter of 2022.

According to the Cosmetics Regulation VO (EC) 1223/2009, formaldehyde is not permitted as a banned substance. Preservatives that release formaldehyde over time and thus contribute to product preservation (e.g., DMDM Hydantoin) are still approved and usable in cosmetic products.

Currently, a specific warning notice must be attached to the end product if it contains more than 0.05% formaldehyde. The exact wording is stipulated in the regulation.

With the expected new regulation from 2022, a warning notice must already be provided for quantities greater than 10 mg/kg of formaldehyde. Corresponding transitional periods for the sale of products are regulated.
