New ALS guideline for the term "Superfood": Classification as a nutritional or health-related claim
The Working Group of Food Chemistry Experts (ALS) made a new decision regarding the designation "Superfood" in its 123rd ALS meeting. The term "Superfood" is associated by consumers not just as a marketing term but also with special nutritional or health-related properties of a food. This is evidenced, among other things, by the Consumer Monitor 2020 - Special Superfoods from the Federal Institute for Risk Assessment. Therefore, the indication "Superfood" is considered a nutritional or non-specific health-related claim within the meaning of Regulation (EC) No. 1924/2006 (Health Claims Regulation, HCVO). According to Article 1 paragraph 3 of the HCVO, such designations are only permissible if they are accompanied by a corresponding nutritional or health-related claim that complies with the provisions of the regulation. Manufacturers that label their products as "Superfood" must ensure that this designation is supplemented by a nutritional or health-related claim authorized under the HCVO.
