Regulation (EU) 2024/858 – Use of Various Nanomaterials in Cosmetics
Through the Regulation (EU) 2024/858 amending Regulation (EC) No 1223/2009 concerning the use of different nanomaterials in cosmetic products dated March 14, 2024, the following compounds are added to Annex (II) – prohibited substances – of Regulation (EC) No 1223/2009:
- Styrene/Acrylates copolymer (nano) / Sodium Styrene/Acrylates copolymer (nano)
- Copper (nano), Colloidal Copper (nano)
- Colloidal silver (nano)
- Gold (nano), Colloidal gold (nano) / Gold Thioethylamino Hyaluronic Acid (nano) / Acetyl heptapeptide-9 Colloidal gold (nano)
- Platinum (nano), Colloidal Platinum (nano) / Acetyl tetrapeptide-17 Colloidal Platinum (nano)
Annex (III) of Regulation (EC) No 1223/2009 is amended as follows:
- Hydroxyapatite (nano) in toothpastes up to 10% and in mouthwashes up to 0.465% (observe further restrictions in the column Other)
As of February 1, 2025, cosmetic products containing the aforementioned substances and not complying with the restrictions of Annex III may no longer be placed on the market.
From November 1, 2025, cosmetic products containing the above-mentioned substances may no longer be made available.
