Revision: Guide for the Description of Food Categories according to Regulation (EC) No. 1333/2008 (EU Additives Regulation)

 

The EU Commission has updated the “Guidance document describing the food categories in Part E of Annex II to Regulation (EC) No 1333/2008 on Food Additives” after five years, and published it in November 2022. The document is available online in English.

In Annex II Part E of Regulation (EC) No 1333/2008, 18 food categories are listed for which certain additives are authorized – either as group or individual authorizations. The classification of highly processed products sometimes poses practical challenges. The guidance document aims to provide assistance here.

Below are a few examples of changes compared to the old version:

-      In category 7.2 “Fine bakery wares”, the descriptions have been supplemented with dough preparations, edible wafers, and edible paper.

-      In category 12.2.1 “Herbs and spices”, detailed descriptions of the terms “herbs” and “spices” are provided for the first time.

-      In category 12.3, it is clarified for “Vinegars” that this category does not include wine vinegars and that they should instead be classified in food category 14.2.2 (“Wine and other products under Regulation (EC) No 1234/2007 and the non-alcoholic counterparts”).

-      In the descriptions for “Food supplements” in food categories 17.1 and 17.2, descriptions for the terms “tablets”, “syrups”, and “in chewable form” are included.
